Sex Offender Tier System in Pennsylvania

Pennsylvania classifies registered sex offenders under a three-tier system that took effect for offenses committed on or after December 20, 2012. The tier determines how long an offender must register and how often they must verify their information. These rules apply uniformly to every Berks County offender.

Tier I offenders register for 15 years and must verify their information with PSP once per year. Tier II offenders register for 25 years and appear for verification twice per year. Tier III offenders carry lifetime registration and must verify quarterly in person. Sexually Violent Predators also register for life and verify quarterly, but they additionally trigger active community notification when they move into a new area. The PSP registration page lists which specific offenses fall under each tier.

Pre-December 2012 convictions are handled under earlier law. Those offenders are classified as ten-year or lifetime registrants and verify annually. Transient offenders with no fixed residence must verify monthly. Any offender whose conviction falls under the newer tier system must also notify PSP at least 21 days before international travel.

Note: Sexually Violent Predators are assessed by the Pennsylvania Sexual Offenders Assessment Board before sentencing. A court makes the SVP determination based on that assessment.

Berks County residents receive active community notification only when a Sexually Violent Predator or Sexually Violent Delinquent Child registers an address in the county.
